  1. Introduction

XUPERMASK LLC (“XUPERMASK”, “we”, “our”, “us”) and its subsidiary and affiliate companies respect the privacy rights of its online visitors (“you”, “your”, “yours”) and recognize the importance of protecting the information collected about them. XUPERMASK collects and stores information from visitors to our site, including those who register their information, download our app, or who use the online store. For example, when you place an order, we collect and store some or all of the following information that you provide: name, billing address, shipping address, email address, and telephone number. Credit card and payment information is only processed through our third-party service provider and not collected or stored at XUPERMASK. We refer to this information as “Order Information.” This Order Information is used to provide the products and services that you have ordered or requested, to process and ship orders, to send order and shipping confirmations and to provide customer service.

If you download our app, the app will collect some or all of the following information that you provide: name, user name, device ID and information, email address, location data, date of birth, usage details, and usage preferences. Some of this information may be aggregated and de-identified to provide overall usage statistics. For example, we may utilize aggregated and de-identified usage details to determine information about battery life and other functional components. Other elements of personal information as provided by you may be utilized to perform services and actions that you request. For example, we may need your name, user ID, or email address to contact you about product warranty information or to provide services related to app development, bug fixes, or upgrades.

This information also may be used for our own marketing and internal business purposes, and to communicate with you, including contacting you about sales, special offers, and new product or service features, unless you have opted not to receive promotional communications from us. To serve you better, we may combine information you give us with other information, which is publicly available.

As indicated above, we may also share this information with third party marketing partners that: (i) provide products or services to us; (ii) that help us provide targeted advertising to you (iii) assist us with internal market research; and (iv) perform any of the other activities allowed under this Policy. You may opt out of targeted advertising by exercising your rights as indicated in the “Your Rights” section below.

We may collect and store certain other information automatically whenever you interact with our products or services. For example, we may collect your IP address, time zone, browser information, some of the cookies installed on your device, and reference site domain name every time you use our products or services. Additionally, as our business continues to grow, we may acquire or sell a business. We reserve the right to transfer business and customer information in connection with such a transaction. In the event that XUPERMASK or substantially all of its assets are acquired, business and customer information may be one of the transferred assets. All business and customer information remains subject to the provisions of the Privacy Policy in place at the time of the asset transfer.

You should also be aware that we might disclose specific information about you if required to do so by law, governmental request, process or court order or based on our good faith belief that it is necessary to conform or comply with such law, request or court order or to protect the users of our products, services, or the public.

Your Rights 

With regard to the collection and use of your personal information, there are certain rights available to you as the data subject. Depending on where you reside, there may be laws or regulations that list these rights specifically.
The section entitled “Use and Collection of Information” above lists the categories of personal information we have collected about residents in the preceding 12 months and how that information is collected. These categories of personal information are as follows:

  • Identifiers including name, age or date of birth, postal address, online, identifier(s), IP address, location data, and email address; 
  • Usage details and user preferences;
  • Internet, devices, or other electronic network activity information;
  • Inferences drawn from any of the information identified above reflecting your preferences and characteristics.

We use and share this information for the following business and commercial purposes:

  • Sharing of your personal information with subsidiaries or group companies and third-party marketing partners & service providers who we use to support our services.
  • Sharing your information with our business partners.
  • Sharing of your personal information where disclosure is necessary to:

  • Protect our rights or property; 
  • Protect the interests of users of the site, products, or services other than you, or any other person;

While we will do our best to honor your request, we may not be able to do so in certain situations where you data is needed or required (e.g., complying with the legal process, record-keeping requirements, or facilitating a transaction upon your request).

When you place an order, we will retain your Order Information for our records unless and until you ask us to delete this information.

Please note that we will not discriminate against you for exercising any of your rights under this Privacy Policy.

When making your request, please indicate your state

of residence (or country of residence if outside of the United States) and include “Privacy Rights Inquiry” as the subject of the correspondence.

If you are located in the EEA, you have the right to lodge a complaint about how we process your personal information with the supervisory authority in your country.

Update Your Information Or Pose A Question Or Suggestion

If you would like to request that we update or correct any information that you have provided to us through your use of the site or otherwise, or if you have suggestions for improving this Privacy Policy, please send an email to privacy@xupermask.com. You may request that content or information you posted to the site is no longer publicly accessible from the site by sending an email to privacy@xupermask.com. After completing the request, we may continue to hold your content and information and such content and information may remain publicly available if your association with the content and information removed or another user posted, copied, or re-posted the content and information.

Do Not Track (“DNT”) is a privacy preference that users can set in their web browsers. When a user turns on DNT, the browser sends a message to websites requesting that they do not track the user. At this time, XUPERMASK ignores these signals. XUPERMASK does not change its practices, described elsewhere in this Privacy Policy, in response to Do Not Track browser settings or signals.
